'Equality before Law' is guaranteed by Article 14 of the Constitution. Article 361 carves out an exception to this rule by giving the President of India and the Governors of states immunity from legal proceedings for acts done in the exercise of their official duties: they are not answerable to any court for the exercise of their powers, no criminal proceeding can be instituted or continued against them, and no process for their arrest or imprisonment can be issued, during their term of office. Because this immunity covers both the President and the Governors, the exception is in reference to the President or the Governor.
